Senate Bills - January 12, 2024

S. 839 (Sen. Alexander) — Amends Section 16-3-85, relating to homicide by child abuse, to increase the age of a child under this section from under the age of 11 to under the age of 18.

S. 840 (Sen. Alexander) — Amending Section 44-23-430, relating to hearings on a person's fitness to stand trial, to require the circuit court to order inpatient treatment of persons determined unfit to stand trial in certain circumstances.

S. 841 (Sen. Alexander) — Enacts the "Prosecutors Personal Privacy Protection Act" by adding Article 9 to Chapter 2, Title 30 to provide current and former prosecutors have the option of making personal contact information held by state or local governments confidential and not subject to disclosure.

S. 842 (Sen. Alexander) — Amends Section 24-13-40, relating to the computation of time served by prisoners, to delete the provision that allows prisoners to use time spent under monitored house arrest against their sentence when computing time served by a prisoner.

S. 845 (Sens. Rankin, Sabb and Talley) — Amends Section 62-3-108, relating to probate, testacy, and appointment proceedings; ultimate time limit, to allow appropriate appointment proceedings for an estate of an individual regardless of the date of death.

S. 848 (Sen. Hutto) — Enacts the "South Carolina Omnibus Firearm Safety Act of 2024" by adding Article 2 to Chapter 23, Title 16 to require that any firearm transfer must be preceded by a criminal background check performed by a licensed firearms dealer with the National Instant Criminal Background Check System.

S. 849 (Sen. Verdin) — Amends Section 44-53-230, relating to Schedule III controlled substances, to add xylazine as a Schedule III controlled substance, with exceptions.

S. 850 (Senator Malloy) — Amends Section 62-3-108, relating to probate, testacy, and appointment proceedings and ultimate time limit, to provide that appointment proceedings may be maintained in relation to the estate of an individual pursuant to Section 804 of the "Honoring Our Pact Act of 2022."

S. 852 (Sen. Davis) — Amends Section 56-1-286, relating to suspension of license or permit or denial of issuance of license or permit to persons under the age of 21 who drive motor vehicles with certain amount of alcohol concentration, to provide that a person issued a notice of suspension may obtain a temporary license with an ignition interlock restriction.

S. 854 (Sen. Davis) — Amends Section 44-130-20, relating to definitions in the South Carolina Overdose Prevention Act, to add organizations providing safer syringe services to the definition of community distributor.

S. 855 (Sen. Davis) — A Joint Resolution to establish the Healthcare Market Reform Measures Study Committee.

S. 856 (Sen. Davis) — Amends Section 6-1-930, relating to developmental impact fees, to provide that system improvement costs do not include repair, operation, or maintenance of existing or new capital improvements or administrative and operating costs of the related governmental entity.

S. 858 (Sen. Davis) — Amends Section 44-7-170, relating to Certificate of Need program exemptions, to exempt acute hospital care at home programs and services.

S. 861 (Sen. Martin) — Amends Section 36-1-201, relating to the definition of "money," to provide that money does not include a central bank digital currency.

S. 869 (Sens. Sabb and Rankin) — Amends Section 62-3-108, relating to probate, testacy, and appointment proceedings and ultimate time limit, to provide that appointment proceedings may be maintained in relation to the estate of an individual pursuant to section 804 of the "Honoring Our Pact act of 2022."

S. 875 (Sen. Rice) — Adds Section 7-13-1180 to require each county board of voter registration and elections to conduct hand count postelection audits of all votes cast within a minimum number of randomly selected precincts.

S. 878 (Sens. Harpootlian and Climer) — Amends Section 22-1-10(a), relating to the appointment and term of magistrates, to provide that magistrates may no longer serve in holdover capacity longer than 90 days.

S. 883 (Sen. M. Johnson) — Amends Section 42-17-20, relating to hearing before the Workers' Compensation Commission on compensation payable, to require the hearing shall be held in the county seat within a district unless an alternative courthouse is provided by the county clerk.

S. 886 (Sen. Tedder) — Amends Section 7-5-320, relating to applications for motor vehicle driver's licenses and voter registration, to provide that each state identification card application or motor vehicle driver's license application, including renewal applications, submitted to the Department of Motor Vehicles shall serve as an application for voter registration.

S. 888 (Sen. Tedder) — Amends Section 24-19-10, relating to definitions for purposes of the Youthful Offender Act, to redefine the term "youthful offender" to change the youthful offender eligibility requirements by tying eligibility to the age at the time of commission of an offense rather than the time of conviction.

S. 889 (Sen. Tedder) — Adds Article 2, to require that any firearm transfer must be preceded by a criminal background check performed by a licensed firearms dealer with the National Instant Criminal Background Check system.

S. 890 (Sen. Tedder) — Amends Section 16-23-440, relating to discharging firearms at or into dwellings, structures, enclosures, vehicles or equipment, and penalties, to provide it is unlawful to knowingly discharge firearms at or in the direction of one or more individuals.

S. 891 (Sen. Tedder) — Adds Article 5 to Chapter 7, Title 6 to establish the "South Carolina Inclusionary Housing Act," to authorize counties and municipalities to adopt and use voluntary inclusionary housing strategies to increase the availability of affordable housing.

S. 892 (Sen. Tedder) — Adds Section 17-13-180 to provide that the scent of marijuana alone does not provide law enforcement with reasonable suspicion or probable cause to support a stop, search, seizure, or arrest.

S. 893 (Sen. Tedder) — Amends Section 59-24-60, relating to the requirement that public school administrators report certain student criminal misconduct to law enforcement, to provide administrators immediately shall refer minor incidents of student fighting to a panel of school board members to review and consider for referral to local law enforcement.

S. 907 (Sens. M. Johnson and Peeler) — Amends Section 12-37-220, relating to property tax exemptions, to provide that the exemption for certain property of a nonprofit housing corporation only applies to the percentage of property that equals the corporation's ownership interest in the property.

S. 909 (Sen. Davis) — Adds Chapter 42 to Title 58 to establish requirements, processes and procedures for electrical utilities to obtain renewable energy and energy storage resources through competitive procurement.

S. 912 (Sen. Davis) — A joint resolution to express support for the SC nexus for advanced resilient energy and to encourage the continued global leadership to reduce the state's environmental impact while enhancing the economic output.

S. 915 (Sens. Peeler, Alexander, Setzler, Verdin, Davis, Hutto and Kimbrell) — Amends Section 1-30-10, relating to departments of state government, to dissolve several departments and create the state office of the secretary of Public Health and Policy.

S. 943 (Sens. Peeler, Alexander, Setzler, Verdin, Davis, Hutto and Kimbrell) — Amends Section 12-37-220, relating to general exemption from ad valorem taxes, to provide that up to two motor vehicles held in trust for the benefit of a disabled veteran are exempt from ad valorem taxes.

S. 944 (Sens. Gambrell, Bennett and Turner) — Enacts the "Paid Family Leave Insurance Act" by adding Chapter 103 to Title 38 to define terms, establish family leave benefits, outline requirements of family leave insurance policies.

S. 945 (Sens. Gambrell and Massey) — Amends Section 6-1-320, relating to millage rate limitations, to allow a municipality without an operating millage on January 1, 2024, or a municipality that incorporates after January 1, 2024, to impose an operating millage and to impose limitations.

S. 953 (Sen. Adams) — Adds Section 6-1-2110 to prohibit a governing body from prohibiting short-term rentals except under certain circumstances.

S. 954 (Sen. Hembree) — Adds Section 17-13-142 to authorize a law enforcement officer, a circuit solicitor, or the attorney general to require the disclosure of electronic communications and other related records by a provider of an electronic communication service or remote computing service under certain circumstances.
