Opt-In Form Due By August 1 For New SC E-Waste Recycling Program
Revisions to the “South Carolina Manufacturer Responsibility and Consumer Convenience Information Technology Equipment Collection and Recovery Act” were approved by the legislature on June 15, 2022, and signed on June 17, 2022, by the Governor. These changes update the Act's definitions to be consistent with technological advances, push the sunset date to December 31, 2029, create a mechanism to initiate stakeholder proceedings in 2026 to review the Act and provide recommendations, update requirements for recoverers and collectors of covered electronic devices, and modify the recycling obligation for television and computer monitor manufacturers from a "pounds requirement" to a "convenience standard."
For covered televisions and computer monitor devices, a county or solid waste authority is eligible, starting in the program year 2023, to opt-in to a manufacturer-funded e-waste program. Manufacturers will fund the transportation and recycling of covered television and computer monitor devices of each county or solid waste authority that participates.
The Act (Section 48-60-140) requires that electronics collected through local government programs must be recovered in a manner that complies with all applicable federal, state, and local requirements.
Counties participating in programs offered by manufacturers pursuant to the Act must submit an opt-in form by August 1, 2022, to participate in the 2023 program year.
Counties that are operating as collectors must also comply with the requirements listed in Section 48-60-141 of the Act.

Electronics Recycling Representative Organization (ERRO) will operate the Manufacturer Clearinghouse for registered computer monitor and television manufacturers in 2023. ERRO’s Clearinghouse administrator, the National Center for Electronics Recycling (NCER), will be conducting outreach along with DHEC to explain the form and answer any questions.
